IPL Auction on January 2013

Posted by: CriK WoRlD

The sixth season of the Indian Premier League is all set to kick start with the much awaited players auction to be held in January 2013 in Kolkata or Chennai. After the recent surprises in the form of the franchises leaving out international stars like Michael Clarke, Tamim Iqbal, Steven Smith, the fans are eager to see which way they go in the upcoming edition.

More importantly, the question mark on the fate of the Pakistani players still is hanging on the sword. Though recent reports reveal that franchises like Rajasthan Royals and Kings XI are eager to have these players in their squads. BCCI is going to decide the matter in its Governing Council meeting before the auction.

Cricket officials are public servants, rules India's Supreme Court

In a ruling that is likely to have widespread repercussions for cricket administration in India, the Supreme Court has upheld a Karnataka High court decision that the officials of the Kerala Cricket Association (KCA) are public servants. The court's decision means that officials who are part of a private body, but perform what can be considered a public function, can now be tried under the Prevention of Corruption Act, 1988, which applies only to public servants. It is the first time the courts have taken such a view of sports administrators in India.
A two-justice bench comprising Justice VS Sirpurkar and TS Thakur dismissed an appeal filed by the KCA president, TR Balakrishanan, and secretary, TC Matthew, who had challenged the High Court's decision allowing them to be prosecuted under the act. The judges first heard the case on January 3, before adjourning it for three weeks as the association wanted more time to file additional documents. The case was finally dismissed yesterday, with the judges calling the High Court's decision a 'beautifully crafted judgement'.
Justice M Shashidharan Nambiar, who passed the High Court order, sought to establish whether the officials fall under the definition of public servant as laid out in the act. The KCA had argued that it was a private body similar to a club, and therefore did not come under the purview of the act. In its order, the High Court observed that the KCA had a monopoly on cricket in the state and performed a public duty and a public service, and so was liable to be prosecuted under the act.
"It [the decision] has far reaching consequences," Matthew told ESPNcricinfo. "In sports associations, people may fight, and those who are defeated may go to court. It opens a Pandora's Box. People can take vengeance in vigilance courts. Nothing will progress. Honest people will not come to work for associations like this."
One such association is the BCCI, of which the KCA is a member. The Indian board has consistently held it is a private organisation and not accountable to the public, but the ruling opens the door for anyone to challenge its officials and those of other cricket associations around the country.
The complainant, Balaji Iyengar , a chartered accountant and former Kerala junior cricketer, had filed the original complaint against the KCA in the Vigilance Court two years ago. The court ruled in favour of the KCA, saying its officials were not public servants, but Iyengar challenged the ruling in the High Court.
"So far sports associations in India have had responsibility without accountability," Iyengar said. "Hopefully this will usher in an era of responsibility with accountability."

Previously Karnataka HC held that  the officials of the Kerala Cricket Association (KCA) are public servants.
In a ruling that could have widespread repercussions for cricket administration in India, the Kerala High Court has said the officials of the Kerala Cricket Association (KCA) can be considered public servants, and directed a lower court to continue hearing a complaint alleging misappropriation of funds by the association. The complaint was filed under the Prevention of Corruption Act, 1988, which applies only to public servants.
The KCA had argued that it was a private body similar to a club, and therefore did not come under the purview of the act. In its order, the High Court observed that the KCA had a monopoly on cricket in the state and performed a public duty and a public service, and so was liable to be investigated by the vigilance department.
The complainant, Balaji Iyengar, a chartered accountant and former Kerala junior cricketer, had filed the original complaint against the KCA in the Vigilance Court two years ago. The court ruled in favour of the KCA, saying its officials were not public servants, but Iyengar challenged the ruling in the High Court. In quashing the lower court's order, Justice M Shashidharan Nambiar held that the officials do fall under the definition of public servant as laid out in the act.
TC Matthew, the KCA secretary, told ESPNcricinfo it would challenge the ruling in the Supreme Court, adding that the decision, if allowed to stand, could result in a number of cases being filed against the BCCI and other sports associations.
Indian cricket's governing body has consistently held it is a private organisation and not accountable to the public but the Kerala ruling could open the door for anyone to challenge the functioning of the BCCI and cricket associations around the country.
"It will be a landmark judgement of sorts if upheld by the Supreme Court," the activist lawyer Rahul Mehra said. "In effect, what you are saying is that these officials are akin to government officials." Mehra famously pursued public interest litigation against the BCCI in 2000 in an attempt to extract more accountability from the board.
The Delhi High Court ruled in Mehra's favour in 2004, saying that the BCCI was accountable to the public as it performs important public functions. That ruling was subsequently upheld by the Supreme Court in a case involving television rights between Zee Telefilms, an Indian television company, and the BCCI. This decision takes things another step further, Mehra said. "It has opened a door which I have been trying to open for about five years."
The ruling has implications for the BCCI and its officials as well. SC in 2005 held that BCCI is not a state for the purposes of Art.13 of Indian constitution. (ZEE Telefilms v. BCCI 2005)

SHOULD EDEN BE RECONSIDERED?????

One of the greatest shock for all the cricket lovers in India and abroad was the ICC ruled out Eden's plea for extention of the timeline for completing rennovations. Earlier ICC inspectors reported that Eden Gardens would not be able to host the India-England fixture in the World Cup 2011 on 27th Feb. Soon after CAB had appealed for such a grant of extention. With ICC having ruled out such plea has drawn curtains on every possibility of Kolkata to witness a clash of the titans.
In this forum we want to know your views on the whole matter. Please do post your views and suggestions.

Daniel Christian shocked after auction success

Despite only playing three Twenty20 internationals for Australia Daniel Christian hit the jackpot after being signed by the Deccan Chargers during this weekends IPL player auction.Despite having a base price of just $50,000, Christian commanded a figure 18 times greater after the Chargers, Delhi Daredevils and new franchise Kochi entered into a bidding war for the 27-year-old.

The final figure of $900,000 set the cricketing world alight with Indian reporters inside the Royal Gardenia Hotel in Bangalore, venue for the auction asking their Australian counterparts who Christian was.

It was a different story for the teams bidding though, Chargers coach Darren Lehmann, Kochi coach Geoff Lawson and the Daredevils Greg Shipperd already knew from first hand experience how deadly Christian is with a bat.

"It'd be nice to earn those kind of figures in a full career. Its been a funny afternoon, to say the least," said Christian after hearing he had been signed by the Chargers.

"Compared to the other guys, I was just hoping to get picked up and play a part in it, so to go for $900,000, words can't really describe it," he added.

"I've had a good few months in state cricket, and by the look of things there's Deccan, Kochi and Delhi who were pretty keen to use my services," he said.

"By the look of the way the auction went yesterday, it looked like a bit of emotion gets involved with some of the owners. I'm lucky enough to be on the receiving end of that."

"It just goes to show how big the game is in India for that kind of money to be thrown around for guys. It's hard to comprehend over here but over there they're fanatical."
It will be interesting to find out whether the owners have their money's worth. But one thing seems to be certain with almost every team having an Aussie coach its all smiles for the budding Aussies wanting to make it to the national squad.

M S Dhoni: Successful but........................

With Dhoni being considered as one of the most successful Indian team,  still some of the critics argue that there are problems with him and question the credit presented to this man. We would be highlighting these, during our discussions:
·         He hardly talks to the players in the ground. We can see clearly from the fact that often we see Tendulkar, Harbhajan, Sehwag, Gambhir or Zaheer talking to the players and motivate them. Similarly, Dhoni don't believe in the ability of his players and clear example of this was Yusuf Pathan during African tour who sat out in first two ODIs just because of Dhoni's disbelief that he can’t perform outside India. Another example is the exclusion of Saurabh Tiwary and S.Sreesanth who are very talented players. Saurabh should have been used in Africa by MSD. He has played just two matches and did not disappoint in either of them. Same is case with Sreesanth. This behaviour will frustrate the young players like Saurabh Tiwary.
·         Some people argue that, nobody can be good a leader without quality players. Hansie Cronje was good b’coz of Kirsten, Cullinan, Fannie, Donald, Pollock etc. Mark Taylor, Steve Waugh were good b’coz of McGrath, Warne,Waugh brothers, Ponting etc. Ponding was doing well bcoz of himself, Lee and some class players like Hussey, Clarke. Ranathunga shined b’coz of Desilva, Jayasurya, Murali, Kaluwithrana.... Dhoni definitely will not have been a good captain without Sachin, Sehwag, Gambir, Harbhajan, Raina, Zaheer. Captaincy is something where team performs even in the absence of big guns and that too, consistently. A large number of people still consider that Ganguly & Azhar lead team India wonderfully than any other fellows.
·         He failed to manage players to an extent and often we heard about his rift with Sehwag, Harbhajan, Zaheer, Yuvraj. This is where people considered Sourav Ganguly as best. Ganguly managed the players well.
·         Sreesanth needs captain like Sourav Ganguly, Imran Khan or Ricky Ponting who were naturally aggressive and showed their emotions and were capable of driving player like Sreesanth to perform well. Dhoni is thanda captain and he hardly show his emotions even team is wins or loses. Dhoni failed to manage players like Sreesanth and get the best of him by not backing him in the trouble times. This is where Ganguly was far better captain than Dhoni as he managed young Harbhajan Singh and Virender Sehwag, Zaheer very well and made them examples in the history of world cricket. Dhoni is thriving on the legacy of Ganguly and certainly he doesn’t have an eye of picking up talent like Ganguly or Imran Khan.
·         Often we see him playing with defensive strategies. We hardly see him employing innovative and offensive strategies. Prime example is final test match in Cape town where he allowed South Africa to build score in excess of 300 after reducing them to 130 for 6. He opened the field and allowed Boucher and Kallis to settle down and form the big partnership. This has happened many times. I never saw in any test match whether in India or abroad in which he had 6 fielders surrounding the batsmen when spinners are bowling even if India is dominating in the match. Clearly shows his lack of faith in his bowlers and lack of creating correct strategy that suits to the situation.
·         No new player has been seen in his captaincy that can be said as developed by MS Dhoni. All the lead players have made their debut under the captaincy of Sourav Ganguly or Rahul Dravid or Anil Kumble. Few players who made their debut in his captaincy failed to find a permanent place in the team. Dhoni failed to groom any player under his captaincy .Eg: Ravindra Jadeja, Murali Vijay, Pragyan Ojha, Amit Mishra, etc. Although there have been players like Yusuf Pathan who made some impact but a bare look on their career easily tells us that they achieved their status on their own.

The list continues...... but the reality remains that he is the one under whose captaincy India captured number one position in Tests. If MSD’s career ends just like that of Ganguly, then the abovementioned problems would certainly run through the veins of your mind once.

City of Joy loses India-England world cup match

It was paradise lost for the City of Joy as the International Cricket Council (ICC) on Thursday ruled out the historic Eden Gardens as the venue for the key World Cup match between India and England after the stadium failed to meet the deadline for completion of renovation.
The ICC has requested the Board of Control for Cricket in India (BCCI) to suggest an alternative venue so that the match can be shifted there. But late in the evening Jagmohan Dalmiya, the president of Cricket Association of Bengal (CAB) who should cop much of the blame for the sordid mess, came up with two suggestions to keep the World Cup matches at Eden.

The first is a swap deal with another association that will allow Eden to host a different match at a later date in exchange for the England match. In another move, he has offered to hand over a 'match-ready' Eden Gardens on February 7 to the ICC. Dalmiya, who has maintained that the Eden would be ready in time to host the February 27 match, said that the extra few days gained would help the CAB to have everything in place to play the perfect host.

The BCCI, on its part, has asked the CAB president to make a written submission in this respect which will be duly forwarded to the ICC, the tournament hosts. All this, however, may not cut much ice with the world body. From all available indication, the swap deal which may upset the entire World Cup schedule, is a non-starter as far as the ICC is concerned. And regarding Dalmiya's offer to hand over Eden by February 7, the ICC will strictly go by the report of its venue-inspection team, which will visit Kolkata again on January 31 to ascertain Eden's preparedness to host the other three non-India matches, scheduled there in March.

If the ICC team finds the pace of renovation work unsatisfactory, it is likely to move the Ireland vs South Africa (March 15), Ireland vs Holland (March 18) and Kenya vs Zimbabwe (March 20) matches out of Kolkata and it would be up to the BCCI to reallocate them.

The ICC, which surprised many by provisionally clearing the newly-renovated Wankhede Stadium despite concerns about the pending work, now wants Mumbai to host the India vs England match.

Specifying the reasons for taking away the match from Eden, the ICC said, "Of particular concern was the fact that host venue obligations in relation to cricket operations, media, broadcast and sponsorship facilities were not finalised and/or confirmed by the venue."
It is not the first time when India has faced embarrassment because of procedural irregularity. There are certain occassion when Indian pitches has been declared unhealthy to play upon. BCCI should look into this issue more seriously having all resources and being the strongest cricket board across the globe.
City of joy would be joyless on 27th Feb. whether India loses or wins.
